Pre-Order Terms

These Pre-Order Terms ("Pre-Order Terms") govern your pre-order of products from FarmHouse Fresh ("we," "us," or "our") through farmhousefreshgoods.com (the "Site"). These Pre-Order Terms are in addition to, and incorporate by reference, our [Terms of Sale], and [Privacy Policy]. By placing a pre-order, you agree to these Pre-Order Terms.

1. What Is a Pre-Order

A "pre-order" is an order placed for a product that is not yet available to ship. The product page will display an estimated ship date or shipping window. Pre-ordered products are not in stock at the time you place your order and will ship on or about the date stated.

2. Order Submission and Acceptance

Your submission of a pre-order constitutes an offer to purchase the product, subject to these Pre-Order Terms. Your offer is not accepted, and no contract is formed, until we charge your payment method. We reserve the right to refuse, limit, or cancel any pre-order at our discretion, including for reasons described in Section 8.

An order acknowledgment confirming receipt of your offer is not an acceptance of your offer. By placing a pre-order, you submit an offer to purchase subject to these terms. We may accept, refuse, limit, or cancel your pre-order in accordance with these terms.

3. Pricing, Errors, and Taxes

All prices are stated in U.S. Dollars and are subject to change before your offer is accepted. The price you pay is the price displayed at the time you place your pre-order, except in the case of a pricing error.

If a product is listed at an incorrect price due to a typographical error, system error, or error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel your order, we will issue a full refund.

Applicable sales taxes will be calculated and added at checkout based on your shipping address.

4. Payment and Charge Timing

By placing a pre-order, you authorize us (and our payment processor) to charge your payment method at the time you place your pre-order. You represent that you are authorized to use the payment method provided.

5. Estimated Ship Date and Delays

The estimated ship date displayed on the product page (the "Estimated Ship Date") is our good-faith estimate based on then-current information. The Estimated Ship Date is not guaranteed. Actual ship dates may vary due to manufacturing, supply chain, shipping carrier, or other factors.

In accordance with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, if we are unable to ship your pre-order by the Estimated Ship Date (or, if no Estimated Ship Date is stated, within 30 days of your order), we will:

(a) notify you by email of the delay and provide a revised ship date; and (b) offer you the option to cancel your order for a full refund or to consent to the revised ship date.

6. Shipping, Title, and Risk of Loss

We will ship your pre-order to the address you provide at checkout. You are responsible for providing an accurate and complete shipping address. We are not responsible for orders delayed, lost, or returned due to inaccurate or incomplete address information.

Title to and risk of loss for your order pass to you upon delivery of the product to your shipping address. Shipping methods, costs, and estimated delivery times are described at checkout and in our [Shipping Policy].

7. Customer Cancellation Before Shipment

You may cancel your pre-order at any time before it ships by contacting customercare@farmhousefreshgoods.com. Upon cancellation, we will issue a full refund to your original payment method. Refunds are typically processed within 5 business days but the time it takes for the refund to appear on your statement depends on your payment provider.

Once your order has shipped, it cannot be cancelled but may be subject to our Returns Policy (see Section 9).

8. Our Right to Cancel

We reserve the right to cancel any pre-order, in whole or in part, at any time before shipment, including for any of the following reasons:

(a) the product becomes unavailable, is discontinued, or cannot be produced or sourced; (b) we suspect the order is fraudulent, was placed in violation of these Pre-Order Terms, or was placed by an automated system, bot, or reseller; (c) you have exceeded any per-customer or per-household quantity limit; (d) the order contains a pricing or product description error; (e) we are unable to verify or charge your payment method; (f) you have an outstanding balance, prior chargeback, or history of order abuse with us; or (g) for any other reason, in our sole discretion, permitted by law.

If we cancel your pre-order, we will notify you by email and issue a full refund of any amounts charged. Our refund of the purchase price is your sole and exclusive remedy in the event of a cancellation by us, to the fullest extent permitted by law.

9. Returns

• Unopened products: Unopened products in their original condition may be returned within 14 days of delivery for a refund of the purchase price, less original shipping charges. Customer is responsible for return shipping unless the return is due to our error.
• Opened products: Due to the seasonal/limited edition nature of Advent Calendar contents, opened products are not eligible for return.
• Damaged or defective items: If your product arrives damaged or defective, contact us at customercare@farmhousefreshgoods.com within 14 days of delivery with a description and photographs of the issue. We will, at our option, replace the product, refund the purchase price, or provide other reasonable remedy.
• How to return: Contact us at customercare@farmhousefreshgoods.com before returning any product to receive return instructions and, if applicable, a return authorization. Returns sent without prior authorization may not be processed.

10. Communications

By placing a pre-order, you consent to receive transactional emails and, where applicable, text messages from us about your order, including order confirmations, shipping updates, delay notices, and post-purchase communications. These transactional communications are not subject to marketing opt-out. Marketing communications are governed by your separate consent and our [Privacy Policy].

10. Force Majeure

We are not liable for any failure or delay in performance under these Pre-Order Terms (other than our obligation to refund amounts paid for cancelled or non-shipped orders) caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, fire, flood, pandemic or epidemic, war, terrorism, civil unrest, government action, labor disputes, supplier or manufacturer failures, carrier delays, internet or utility outages, cyberattacks, or material shortages.

11. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE PRE-ORDER TERMS OR REQUIRED BY APPLICABLE LAW, ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO YOUR PRE-ORDER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRE-ORDERED PRODUCT GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. NOTHING IN THESE PRE-ORDER TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Changes to These Pre-Order Terms

We may update these Pre-Order Terms from time to time. The Pre-Order Terms in effect at the time you place your pre-order govern that pre-order. The "Last Updated" date at the top reflects the most recent revisions. Material changes will be posted on this page.

14. Miscellaneous

(a) Entire Agreement. These Pre-Order Terms, together with the documents incorporated by reference, constitute the entire agreement between you and us regarding your pre-order. (b) Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. (c) No Waiver. Our failure to enforce any provision is not a waiver of that or any other provision. (d) Assignment. You may not assign or transfer your rights or obligations under these Pre-Order Terms. We may assign without restriction. (e) Headings. Headings are for convenience only and do not affect interpretation.
